2013 Trial Pass Terms and Conditions
These are the Terms & Conditions that apply to the RaboDirect Rebels Trial Pass promotion for the 2013 Super Rugby home and away season.
These Terms & Conditions form a legally binding contract ("Agreement") between Trial Pass Holder and RaboDirect Rebels.
Under the Agreement, the Trial Pass Holder promises to comply with these Terms & Conditions including any Rules & Regulations imposed by the Venue on Trial Pass Holders.
Interpretation
In these Terms & Conditions, the expression:
• "British & Irish Lions Test Match" refers to the match between the Australian Wallabies and the British & Irish Lions on Saturday, 29 June 2013 at Etihad Stadium
• "British & Irish Lions Tour Match" refers to the match between the RaboDirect Rebels and the British & Irish Lions on Tuesday, 25 June 2013 at AAMI Park Stadium
• "Home Match" refers to any of the matches designated as a RaboDirect Rebels home match during the 2013 Super Rugby home and away season, and excludes any Finals Match
• "Finals Match" refers to any match designated as a RaboDirect Rebels home finals match played at a Venue
• "RaboDirect Rebels" refers to Melbourne Rebels Rugby Union Ltd ABN 70 140 597 066
• "Trial Pass" refers to the definition in these Terms & Conditions
• "Trial Pass Holder" refers to any person who holds a Trial Pass, who complies with these Terms & Conditions and who has not cancelled or surrendered the Trial Pass under these Terms & Conditions
• "Venue" refers collectively to AAMI Park Stadium, Etihad Stadium and any other stadium where a RaboDirect Rebels Home Match or Finals Match is played
If there is any inconsistency between information on the RaboDirect Rebels Trial Pass and these Terms & Conditions, then these Terms & Conditions will prevail.
Trial Pass entitlements
A trial pass entitles the Trial Pass Holder to one (1) General Admission Family Ticket for one (1) RaboDirect Rebels Home Match during the 2013 Super Rugby home and away season ("Trial Pass")
A General Admission Family Ticket includes 2 Adults and 2 Juniors OR 1 Adult and 3 Juniors. A Junior must be 4 year or over and 16 years or under as at 1 October 2012.
Trial Pass redemption
A Trial Pass must and can only be redeemed for a RaboDirect Rebels Home Match General Admission Family Ticket at any Ticketek office at the Venue on the day of the Home Match and by no earlier than 2 hours prior to the commencement of a Home Match and by no later than 1 hour after commencement of a Home Match.
The Trial Pass Holder is requested to complete the personal details on the Trial Pass prior to redeeming the Trial Pass.
All dates, times, participating teams and venues of Home Matches will specified on the official Super Rugby website www.rugby.com.au and may change from time to time without notice to Trial Pass Holders.
Redemption of a Trial Pass is subject to available capacity at the Venue at each Home Match.
Trial Pass conditions
Only one (1) Trial Pass may be redeemed per person during the 2013 Super Rugby home and away season.
Trial Passes are non-refundable and unable to be exchanged for cash or otherwise.
It is a condition that a Trial Pass to RaboDirect Rebels Home Matches may not, without the prior written consent of the RaboDirect Rebels, be resold at a premium nor used for advertising, promotion or other commercial purposes (including competitor or trade promotions) or to enhance the demand for other goods or services. If a Trial Pass is sold or used in breach of this condition, then the Trial Pass may be cancelled and the bearer of the Trial Pass may be denied admission.
The organisations in control of the Venues used for RaboDirect Rebels Home Matches have the right to impose on Trial Pass Holders Rules & Regulations and other operational decisions as may be directed by those organisations from time to time in its discretion. RaboDirect Rebels shall not be liable to Trial Pass Holders for any matters arising as a result of the implementation of any such Rules & Regulations.
It is a condition of redemption that Trial Pass Holders must comply with these Terms & Conditions, including the Rules & Regulations imposed by the organisation in control of the Venues, where RaboDirect Rebels Home Matches are played. If any of these Terms & Condition or Rules & Regulations are breached, RaboDirect Rebels and the Venue reserves the right to refuse entry or to remove Trial Pass Holders from the Venue at its absolute discretion.
RaboDirect Rebels is not liable to Trial Pass Holders for any loss or damage you suffer as a result of the Super Rugby Competition or any Home Match being cancelled, postponed or changed.
Trial Passes expire at 21:00 on 12 July 2013 unless cancelled or surrendered earlier under these Terms & Conditions.
Trial Passes are not inclusive of entry to pre or post 2013 Super Rugby home and away season matches, Finals Matches, the British & Irish Lions Tour Match and the British & Irish Lions Test Match.
RaboDirect Rebels reserves the right to cancel a Trial Pass without refund if the Trial Pass Holder breaches these Terms & Conditions or any Rules & Regulations imposed by the Venues on Trial Pass Holders.
Trial Pass Holder rights
A RaboDirect Rebels Trial Pass does not entitle the Trial Pass Holder to any other right except as expressly set out in these Terms & Conditions.
A Trial Pass does not give a Trial Pass Holder the right to vote in any meeting of RaboDirect Rebels, to vote for any position on the Board of Directors or to participate in any dividend entitlement of any nature whatsoever.
Misuse of Trial Pass
If RaboDirect Rebels become aware of the misuse of a Trial Pass, the Trial Pass Holders' rights may be suspended and/or the Trial Pass may be cancelled, at the discretion of RaboDirect Rebels.
Privacy Notification
RaboDirect Rebels respects the privacy of the individuals on whom RaboDirect Rebels collects, uses, discloses and holds personal information. RaboDirect Rebels has a Privacy Policy that is based on the National Privacy Policy Principles contained in the Privacy Act 1988 (Cth).
RaboDirect Rebels uses the personal information it collects on the Trial Pass for the purpose of processing and administering the Trial Pass and providing you with information, materials and promotions relating to RaboDirect Rebels and its sponsors, and will be applied in accordance with these Terms & Conditions.
By redeeming a Trial Pass for a RaboDirect Rebels Home Match, you agree that your personal information pertaining to the Trial Pass may be disclosed to RaboDirect Rebels' sponsors. Subject to the preceding paragraph, you may be contacted by RaboDirect Rebels and RaboDirect Rebels’ sponsors in connection with their special offers and other information about their services and products. If you do not wish to receive any such information, please provide notification at the time of redeeming the Trial Pass.
